1. Official Rules: Notwithstanding any applicable laws, the present rules regulate all aspects of the contest and bind all participants.
2. Introduction: Dan Fournier ("Sponsor"), author of The Young Investor: The North American Guide to Investing Online ("Book") (see http://TheYoungInvestor.net), is offering the Online Contest ("Contest"). NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.
3. Eligibility: a) The contest is open to those participants who complete the online investment questionnaire at http://TheYoungInvestor.net/Contest/ in full and who receive an html message confirming he or she is now eligible for the draw. Your chances of winning depends on the number of participants who participate during the contest. ANSWERING THE ONLINE QUESTIONNAIRE MORE THAN ONCE DOES NOT IMPROVE YOUR CHANCE OF WINNING.
b) Entrant must be 18 years of age at the time of entry or must of legal age according to the legislation of their residence place. For the cash prize, entrant must be a legal resident of one of the 10 Canadian provinces or 3 Canadian territories, or of the 50 United States and the District of Columbia. The Sponsor or any of his employees, their parents, subsidiaries, affiliated companies, and agents and the immediate family (defined as parents, spouse, children, siblings, grandparents) of each such employees or the Sponsor, and all those with whom such employees are domiciled, are NOT eligible.
4. Duration: Contest begins at 12:00:01 a.m. E.S.T. (Eastern Standard Time) on February 15, 2008, and ends at 11:59:59 p.m. E.S.T. on Tuesday, December 30, 2008.
5. Prize: A Cash prize of $2,000 Canadian dollars will be awarded to the winner.
6. How to Enter: Simply complete and submit the online investment questionnaire at http://TheYoungInvestor.net/Contest/. MORE THAN ONE ENTRY FROM ANY PERSON OR E-MAIL ADDRESS WILL VOID ALL ENTRIES FROM THAT PERSON OR E-MAIL ADDRESS.
7. Deadline: Tuesday, December 30, 2008 at 11:59:59 p.m. E.S.T.
8. Awarding the Prize: From the complete list of participants who entered the contest within the prescribed deadline, a random draw will be conducted by the Sponsor under the supervision of two neutral witnesses on Wednesday, December 31, 2008, to determine the winner. The winning participant will be notified by e-mail and will have fourteen days to respond and claim the prize; if the participant does not respond within fourteen days, the prize may be attributed to another participant.
9. Publicity: By accepting the prize, the winner agrees that the Sponsor and those acting under the Sponsor's authority, may use winner's name, address, picture/portrait likeness and/or voice, for advertising and promotional purposes without further consideration, unless prohibited by law, and this, without any form of compensation.
10. Applicable Laws: This Contest is governed by the laws of Quebec and in accordance with R.S.Q., chapter L-6 AN ACT RESPECTING LOTTERIES, PUBLICITY CONTESTS AND AMUSEMENT MACHINES. This Contest is subject to all federal, provincial and municipal laws and regulations. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. All taxes or fees on winnings are the sole responsibility of the winner.
11. Litigation (for residents of Quebec only): Any litigation concerning the organization or how the current contest is held can be submitted to the Régie des alcools, des courses et des jeux in Quebec. Similarly, any litigation concerning how prizes are awarded under the current contest can also be submitted to the Régie des alcools des courses et des jeux, for the sole purpose of regulation.
12. Termination: Subject to the jurisdiction of the Régie des alcools, des courses et des jeux in Quebec, the Sponsor reserves the right to amend or terminate all or any portion of this Contest at any time for any reason without prior notice.
13. Other Terms and Conditions: BY ACCEPTING THE PRIZE, THE WINNER AGREES THAT THE SPONSOR, HIS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THE SPONSOR'S OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST.
14. Miscellaneous: All entries become the sole property of Sponsor and none will be returned. In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right at his sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Contest. Sponsor is not responsible for late, lost, illegible, incomplete, stolen, or misdirected entries. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
15. Privacy Policy: The Sponsor respects the privacy of all contestants. The Sponsor will not sell, share, or rent contestants' personal information or e-mail addresses to any third party without consent.
